Federal Detention & ICE Abuse Lawyer

When the federal government detains someone, it assumes responsibility for their safety.

If a person is wrongfully detained, beaten by a federal officer, denied medical care, or dies in ICE custody, the legal framework is different from a typical police misconduct case. These claims are usually brought under the Federal Tort Claims Act (FTCA), and the rules are technical, strict, and aggressively defended. Early legal analysis can determine whether the case survives.

Federal detention cases we handle

How federal detention cases are different

Most ICE and federal custody cases are not brought under the same rules as local police misconduct claims.
Many are pursued under the Federal Tort Claims Act (FTCA), which is a limited waiver of sovereign immunity.

  • Administrative claim first: you generally must file with the correct agency before filing suit.
  • Strict deadlines: missing them can end the case immediately.
  • Different defendants: the United States is typically the defendant, not just the individual officer.
  • Common defenses: “discretionary function” and “independent contractor” defenses are frequent.

Common issues we evaluate

Wrongful detention

Detention that exceeds lawful authority, continues without proper basis, or violates required procedures may support an FTCA claim framed as false imprisonment or negligence under applicable state law.

Excessive force

Certain assault and battery claims may be actionable when committed by federal law enforcement officers acting within the scope of employment. These cases are evidence-driven: what happened, what was necessary, what was excessive, and what the records show.

Medical neglect and suicide

Failure to provide required medical or mental health care, delayed emergency response, and missed suicide-risk screening can form the basis of negligence or wrongful death claims under the FTCA, depending on the facts and applicable standards.

Contractor-run facilities

Many detainees are held in privately operated facilities. Contractor operation creates additional issues, but it does not automatically erase federal responsibility for required oversight or non-delegable duties, depending on the facts and applicable law.
